«Management company SEZ «Khorgos-East gate» was founded on December, 21, 2011.
In accordance with the article 18 of the Law of The Republic of Kazakhstan «About special economic zones in the Republic of Kazakhstan» from July, 21st, 2011 № 469-VI functions of controls of the special economic zone are defined, including:
- interaction with the state structures concerning functioning of the special economic zones;
- granting in secondary land tenure (sub rent) of the ground areas and granting in rent (sub rent) of objects of an infrastructure to the persons who are carrying out bridging kinds of activity;
- the conclusion and cancellation of contracts on activity realization;
- representation to the authorized body of the reporting about results of activity of special economic zones in the order established by authorized body, on the basis of annual reports of participants of special economic zones;
- attraction of participants of a special economic zone;
- attraction of investments for building objects of an infrastructure and for realization of other kinds of activity of special economic zones;
- realization of building of objects of an infrastructure according to the confirmed feasibility report on the ground areas which have not been transferred to participants of a special economic zone;
- the organization of a place of reception for functioning of the center of service of the population by a principle of «one window»;
- acknowledgement of actual consumption of the imported goods at realization of the activity answering to the purposes of creation of special economic zones;
- monitoring the performance of conditions of contracts on activity realization
«Management company FEZ «Khorgos-East gate» is created with participation of JSC «National center of transport logistics development» — a subsidiary company JSC «NC «KTZh».
Law substantive provisions about SEZ on the Management company
- Transition from government management of SEZ to private management
- Management SEZ by means of Management company establishment in the organizational-legal form of joint-stock company
- as Founders of the Management company besides Government of RK and local executive powers, foreign and non state legal bodies act are independently eligible
- Foundation together with the investor of controls of SEZ, if the initiator of its creation was the investor. (In this case the state is given not less than 26% of voting actions)
- the structure of controls of a management company can include representatives of investors, Governments of RK, local executive powers.
